The Possession Of Marijuana Is A Serious Offense In Illinois

If you are charged with marijuana possession in Illinois, you may face many significant penalties, including jail time and fines. As a college student, these penalties can be even harsher. For instance, following a criminal conviction on marijuana charges, you run the risk of losing many forms of federal financial aid ― including federal loans and grants. For some, the loss of this aid can be the difference between being able to afford school or not. A conviction can literally jeopardize your future.

At Clark, Glasgow and McClintock, LLC, we understand exactly what is at stake when you are charged with marijuana possession. There is simply no substitute for experience, and our two attorneys have more experience than most ― a combined 46 years. Hiring an attorney who knows how to navigate these laws is essential if you wish to ensure your rights are protected.

Marijuana Possession Is A Criminal Offense

The penalties for marijuana possession are much more than a simple slap on the wrist. In fact, while some states have legalized ― or at least decriminalized ― marijuana possession, it is still a criminal drug offense in Illinois. For instance, under Illinois law:

  • The possession of not more than 2.5 grams of marijuana is a class C misdemeanor
  • The possession of more than 2.5 grams of marijuana, but no more than 10 grams, is a class B misdemeanor
  • The possession of more than 10 grams of marijuana, but no more than 30 grams, is a class A misdemeanor, although a second offense is a class 4 felony
  • The possession of more than 30 grams of marijuana, but no more than 500 grams, is a class 4 felony, with a second offense being a class 3 felony

It is also important to keep in mind that if prosecutors decide to charge you with possession with intent to sell, you will likely face even harsher penalties.
